National Laws and the Rights of Persons with Disabilities – The Initial Step of the Jakarta Declaration

Introduction: Change within any society begins with its laws. The Jakarta Declaration (2023-2032) has prioritized “Harmonizing National Legislation” as its first goal. Simply put, this means adjusting all existing laws to align with the international rights of persons with disabilities.

Why Is Legal Reform So Crucial? Many countries have laws that address the needs of persons with disabilities; however, these are often rooted in notions of charity or sympathy. The Jakarta Declaration urges a shift towards framing these laws around the concept of rights. Until laws recognize persons with disabilities as equal citizens, they will continue to face disparities in education and employment opportunities.

Key Actions for Governments:

  • Eliminating Discrimination: Revise or abolish laws that unfairly disadvantage persons with disabilities.
  • Adopting International Standards (CRPD): Develop local laws in accordance with the United Nations Convention on the Rights of Persons with Disabilities (CRPD), ensuring legal protections are in place.
  • Establishing Complaint Mechanisms: Create clear legal channels through which persons with disabilities can seek justice if they face discrimination or injustice.

Context in Pakistan: While Pakistan has enacted laws like the Disability Rights Act of 2020, the Jakarta Declaration reminds us that there is still considerable work to bring provincial laws and policies in line with international standards.
